App Studio Terms

These terms govern your use of App Studio, thehyperscale.io and optional managed hosting. App Studio is operated by Hyperscale Consulting Ltd ("we", "us" and "our"). By creating an account or buying a plan, you agree to these terms.

App Studio

App Studio helps you plan, generate, test and host software using automated and AI-assisted tools. Outputs can be incomplete or wrong. Because App Studio is built for non-technical founders, your responsibility is to review and verify the outputs it produces — the generated text and the interactive visual designs — in plain language, to confirm they do what you intend. App Studio handles the technical testing; what we encourage you to do is usability testing with your target users — watching a few real users try the key tasks and listening to their feedback — which helps you catch problems early and improve adoption before you rely on your application or make it widely available.

Your account

You must provide accurate account information, keep sign-in details secure and tell us promptly about suspected unauthorised access. You are responsible for activity through your account.

Your content and ownership

You retain ownership of content you submit and the application created for you. You give us the limited permission needed to process, store and transmit that content to provide, secure and improve the service. You must have the right to submit all content and must not use App Studio to infringe rights, break the law or harm others.

Acceptable use

You must not attempt unauthorised access, interfere with the service, distribute malware, evade usage limits, generate unlawful content or use App Studio for high-risk decisions where failure could cause death, personal injury or serious environmental harm.

Plans, credits and VAT

Current prices and included usage are shown before purchase. All prices exclude VAT unless stated otherwise. Build plans and managed hosting are separate. Credits measure use of paid platform capabilities, have no cash value and are forfeited when the relevant subscription ends.

Subscriptions, renewal and cancellation

Paid subscriptions renew for the selected billing period until cancelled. You may cancel renewal at any time before the next billing date. Monthly fees already paid are non-refundable. Annual subscriptions are non-refundable except where law requires otherwise. Cancellation does not remove amounts already due.

Price changes

We may change future prices or plan limits by giving at least 30 days' notice. A change applies from your next renewal after the notice period.

Managed hosting

Managed hosting includes the capacity and features shown for your plan. We may carry out maintenance and take reasonable steps to protect reliability and security. We do not promise uninterrupted availability. If hosting ends, we retain hosted application data for 30 days to allow recovery, then delete it unless law requires otherwise.

Third-party services

Your application may use third-party products, APIs, AI models or payment services. Their own terms and availability apply. You are responsible for licences, accounts and charges not expressly included in your App Studio plan.

Confidentiality and data protection

Each party will protect the other's confidential information. Our processing of personal information is described in the Privacy Policy. If we process personal data for your hosted application, additional data-processing terms may be required.

Service changes and suspension

We may change App Studio as it develops. We may suspend access where reasonably necessary for security, non-payment, legal compliance or a serious breach of these terms.

Warranties and liability

App Studio is provided with reasonable care and skill. To the fullest extent permitted by law, we exclude implied warranties not stated here and are not liable for indirect or consequential loss, lost profit, lost opportunity or loss caused by your failure to review an output or maintain suitable back-ups. Nothing excludes liability that cannot legally be excluded.

Ending these terms

You may stop using App Studio and cancel paid renewals. We may terminate for a material breach that is not corrected after reasonable notice, or immediately where continued service would create a security or legal risk.

Governing law

These terms are governed by the laws of England and Wales, whose courts have exclusive jurisdiction, subject to any mandatory consumer rights.
